These terms are the agreement between you and Parametric AI for use of our website, web application and mobile app. Section 6 explains what our valuations are not, and sections 12 to 14 limit our liability. Please read those closely.
By creating an account, signing in, or otherwise using the Parametric AI website, web application or mobile app (the "Service"), you agree to these terms. If you are agreeing on behalf of a brokerage, you confirm you have authority to bind it, and "you" means both you and that brokerage. If you do not agree, do not use the Service.
Where a brokerage has signed a separate written agreement with us, that agreement governs if it conflicts with these terms.
The Service is offered only to real estate brokerages licensed in British Columbia, to their licensed agents, and to their authorised staff. You must have reached the age of majority in your province. We provision accounts through brokerages; access requires an active brokerage account, and we may verify that a licence is active and in good standing before granting or continuing access.
Accounts are personal to the individual they are issued to. Do not share credentials, and do not let anyone else use your account. You are responsible for what happens under your account. Tell us promptly at security@pmetric.ai if you believe it has been compromised. We may require multi-factor authentication.
The Service is under active development and parts of it are offered on an early-access or pre-release basis. Features may change, be withdrawn or behave unexpectedly, and the Service may be unavailable at times. We do not commit to any particular level of availability, and we do not guarantee that data you enter will be preserved without loss. Keep your own copies of anything you cannot afford to lose.
The Service produces statistical estimates of property value, ranked comparable sales, market indicators, comparative market analyses, and pre-populated British Columbia real estate forms, and it stores the client and transaction records you enter. Estimates are generated by automated models from closed sales, listing data, and land and assessment records.
A Parametric estimate is not an appraisal. It is not prepared by a licensed or accredited appraiser, it does not comply with the Canadian Uniform Standards of Professional Appraisal Practice, and it must not be described or relied on as an appraisal.
It is not advice. Nothing in the Service is financial, investment, legal, tax or lending advice, and it is not a recommendation to buy, sell or price at any particular figure.
It does not replace your judgment. You are the licensed professional. Every number the Service produces is an input to your own analysis, which you are responsible for reviewing before you act on it or show it to a client.
Estimates are probabilistic and carry error. A property can sell well above or well below any figure the Service shows, and accuracy varies by property type, location, data quality and market conditions. Any published accuracy figure describes historical performance across a tested population; it is not a promise about a particular property. Where the Service indicates low confidence, thin comparable evidence, or missing data, treat the estimate as unreliable.
Property, assessment and listing data comes from third parties. We do not warrant that it is accurate, current or complete, and errors in that data will flow through to the outputs.
Do not present a Parametric estimate to a client, lender, insurer, court or regulator as an appraisal or valuation opinion. If you share an output with a client, you are responsible for its content, for how it is characterised, and for meeting the disclosure and advertising rules that apply to you.
Using the Service does not change or discharge any duty you owe. You remain solely responsible for complying with the Real Estate Services Act and the rules of the BC Financial Services Authority, your brokerage's policies, your MLS board's rules, the Proceeds of Crime (Money Laundering) and Terrorist Financing Act and FINTRAC requirements, and applicable privacy law. Features that assist with compliance forms and record-keeping are conveniences; they are not a compliance program, and we do not verify that what you produce with them is correct or complete.
You are responsible for having the consent or other legal authority needed to enter a client's personal information into the Service, and for telling that person how their information will be handled. You must not enter information you are not permitted to disclose to a service provider. We handle client records on your brokerage's behalf as described in our Privacy Policy.
MLS listing data is made available under the licence your brokerage holds with its board, and your use of it is subject to that licence and your board's rules. You may use it in the Service for your own professional work with clients. You may not scrape, bulk-export, redistribute, resell or republish listing or property data obtained through the Service, or use it to build or train a competing product or model. Access to boards your brokerage is not licensed for is not permitted, and we may suspend access on a board's instruction.
You agree not to:
We own the Service, including our software, models, model outputs in aggregate, report designs, and the Parametric AI name and marks. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your own professional real estate work while your account is active.
You keep ownership of the content you enter, including your client records, notes, documents and branding. You grant us a licence to host, process, transmit and display that content as needed to operate, secure and support the Service, and to create backups.
If you send us feedback or suggestions, we may use them without obligation to you.
To the maximum extent permitted by law, the Service and everything in it are provided "as is" and "as available", without warranty of any kind, whether express, implied or statutory. We specifically disclaim any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty as to the accuracy, reliability, completeness or currency of any valuation, estimate, comparable, market indicator, form, report or data supplied through the Service.
We do not warrant that the Service will be uninterrupted, timely, secure or error-free, or that defects will be corrected.
Some jurisdictions do not allow the exclusion of certain warranties. In those places, this section applies to the fullest extent the law allows, and nothing here excludes a right that cannot lawfully be excluded.
To the maximum extent permitted by law, and except for liability that cannot lawfully be limited:
These limits apply to all claims, whether in contract, tort (including negligence), statute or otherwise, and survive termination. They allocate risk between us and are reflected in our pricing. Nothing in this section limits liability for fraud, fraudulent misrepresentation, or anything else that cannot be limited under the law of British Columbia.
You will indemnify and hold harmless Parametric AI and its directors, officers, employees and contractors from any claim, loss, liability, damage, penalty, cost or expense (including reasonable legal fees) arising from your use of the Service, your breach of these terms, your breach of any law or professional obligation, the content you enter, or the way you present an output of the Service to any third party. We will notify you of any such claim and you may control the defence, provided you do not settle in a way that imposes an obligation on us without our written consent.
Subscription fees, the billing period and any trial are set out in the order or plan agreed with your brokerage. Fees are payable in advance and, unless stated otherwise, are exclusive of applicable taxes. Payments are processed by Stripe, and you agree to Stripe's terms for that processing. Except where the law requires otherwise or we state otherwise in writing, fees are non-refundable. We may change fees on 30 days' notice, effective at the start of the next billing period. Non-payment may result in suspension.
You may stop using the Service at any time; a brokerage may cancel its subscription in accordance with its plan. We may suspend or terminate access immediately if you breach these terms, if your licence lapses or is suspended, if your brokerage's account is closed or unpaid, if a board or regulator requires it, or if we reasonably believe continued access presents a security or legal risk.
On termination, your right to use the Service ends. You may request an export of your content before your account is closed and for 30 days afterwards. Sections 6, 8, 11 through 14, 17 and 18 survive termination.
These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply in it, without regard to conflict-of-laws rules. You and we submit to the exclusive jurisdiction of the courts of British Columbia, sitting in Victoria, and you waive any objection to that venue. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
These terms, together with our Privacy Policy and any written agreement with your brokerage, are the entire agreement between us about the Service. If a provision is held unenforceable, it is severed and the rest continues in force, with the unenforceable part read down to the extent needed to make it enforceable. Our failure to enforce a provision is not a waiver of it. You may not assign these terms without our written consent; we may assign them to a successor of our business. There are no third-party beneficiaries. Nothing here creates a partnership, joint venture, employment or agency relationship.
We may update these terms. The version number and effective date at the top of this page reflect the current version, and we will give account holders notice by email or in the Service before a material change takes effect. Continuing to use the Service after that date means you accept the change; if you do not, stop using the Service and cancel.
